Estate Planning

Comprehensive Estate Plan Bundle
James will consult with you and create a comprehensive plan custom-tailored to meet your unique needs all for one fair flat fee agreed upon at the outset of the estate planning process. Your flat rate includes consultation regarding, custom preparation of, and execution of the following core estate planning documents:
A revocable living trust,
Pour-over wills,
Powers of attorney, and
Advance directives for health care.
This flat rate also covers preparation and execution of ancillary documents as appropriate, including:
Nominations of guardians and conservators,
Appointments of persons to make decisions concerning disposition of remains,
Bargain and sale deeds transferring Oregon real property to the trust,
Assignments of tangible personal property to the trust,
Assignments of interests in wholly-owned companies to the trust,
Assignments of loans to the trust, and
Certifications of trust.

Don’t worry, by listening to your story and collaborating with you throughout the process, James will ensure that your comprehensive estate plan addresses your unique needs with the appropriate custom-tailored legal tools. And James will consider and consult with you on tax implications as part of all estate planning packages; it’s included.
How We Calculate Our Flat Rates
We arrive at our flat rates on a case by case basis; some of the factors that contribute to the determination of that rate include whether the estate plan is for an individual, a couple, or a couple with a taxable Oregon estate, and whether the estate plan calls for specialized documents that address certain unique assets or circumstances such as:
A/B Trust, Bypass Trust, or Disclaimer Trust for a Couple—useful for maximizing tax savings and/or for providing for the surviving spouse while protecting the inheritance of separate children in blended families.
Separate Trusts for a Couple—useful for maintaining independent finances (in addition to maximizing tax savings and/or for providing for the surviving spouse while protecting the inheritance of separate children in blended families).
Third-Party Special Needs Trust—useful for preserving public benefits for those with disabilities.
Additional Single-Asset Trust:—useful for complying with agency regulations and preserving privacy when handling unique assets like an airplane or a National Forest Service cabin lease.
Note, however, that our rates do not include state and local filing fees such as fees for recording deeds (which are currently $93 for one page in Deschutes County, for example).

Estate Administration

Probate & Trust Administration
James will guide you through the entire process, from helping you figure out whether you need to or should go through probate to acting as counsel for the personal representative or trustee when appropriate. Fees for estate administration matters are billed on an hourly basis plus costs and expenses. While it is difficult to estimate the total amount of time and expense that will be necessary in advance, James makes every effort to keep you informed of costs on an ongoing basis with regular communication and detailed billing statements.
